Fertility Law

In Ontario, intended parents who use a surrogate may be named as the child’s parents on the birth certificate without pursuing a formal adoption, provided a Surrogacy Agreement is in place prior to conception. A Surrogacy Agreement also sets out the rights and obligations of the intended parents and the surrogate throughout their relationship. If you are considering using a surrogate, or becoming one, our office is pleased to offer a consultation to discuss your rights and the factors you should consider. We prepare Surrogacy Agreements and provide Independent Legal Advice to surrogates and intended parents on an agreement before it is signed.

Sperm Donor Agreements

Ontario is the only province in Canada that permits conception through sexual intercourse with a sperm donor without automatically making that donor a legal parent, provided a written agreement between the parties is in place prior to conception. If you are considering using a sperm donor, or becoming one, our office is pleased to offer a consultation to discuss your rights and the factors you should consider. We prepare Sperm Donor Agreements and provide Independent Legal Advice to donors and intended parents on an agreement before it is signed.
